The Nebraska Supreme Court will hear arguments this week in the case of an Omaha couple who say they've been unfairly ordered to shutter their home-based child care service.
Glen and Rhonda Wolf appealed after a Douglas County court found in favor of Farmington Woods Homeowners Association, who sued over the Wolfs' child care service. The association says the service violates covenants against conducting ``business activities of any kind'' out of the neighborhood's homes.
The Wolfs say the association allowed them to run the day care for 12 years without complaint and continues to allow others in the neighborhood to run businesses from their homes, including the association's president.
The association argues that tolerance of ``incidental'' businesses at other homes does not prohibit it from challenging the Wolf's day care.
