Lancaster County District Judge Robert Otte ruled on the challenge this week in the case against a 22-year-old Lincoln man.
Armani Flood is charged with discharging a firearm from a vehicle and a weapons count. Police say Flood was driving a car from which a passenger fired a rifle several times, hitting other vehicles. No one was injured.
Flood's attorney, Peter Blakeslee, argued the drive-by shooting law is unconstitutional because it treats identical conduct in different places differently.
The judge found that Blakeslee failed to prove that the state law, which is intended to address gang violence, is unconstitutional.
