Deadly Shooting Ruled Accidental

Omaha Police say a 31 year old man shot to death earlier this week was involved in a domestic disturbance when the gun went off.

The altercation happened at Sonesta Suites at 69th and Dodge around 2:30 Wednesday morning.  Police say there was a struggle over a gun when it went off, striking Middlebrook.  He was pronounced dead at the scene.

One person was taken in for questioning, but after consulting with Douglas County Attorney Don Kleine,  it has been determined no charges will be filed in this "tragic incident."
