(Sarpy County, NE) -- Charges are upgraded for a Bellevue father accused of killing his children back in May.

On Tuesday, the Sarpy County Attorney's Office released a statement saying that, "The State filed a motion to amend the charges in State v. Adam Price to two counts of First Degree Murder." Price’s two children, 5-year-old Emily and 3-year-old Theodore, were found dead in his home during a welfare check on May 16th. Price and the children's mother, who lives in Illinois, were going through a divorce at the time. The children's mother had not heard from Price or her children in several days, which led to the welfare check. Price fled Nebraska following the deaths of the children and was arrested by law enforcement in Pacifica, California the same day his children's bodies were discovered.

Price has been held in the Sarpy County Jail on two counts of Child Abuse resulting in death since May 27, after being extradited back to Nebraska from California, . “Recently obtained autopsy reports show that Emily and Theodore died by asphyxia due to smothering. Based on this new information, the State filed a motion to amend the charges to two counts of First Degree Murder,” Chief Deputy Sarpy County Attorney Bonnie Moore said.

Price is scheduled to appear in court on Tuesday, October 12th regarding the State’s motion to amend the charges to First Degree Murder. If convicted, Price faces life in prison.
